Butch vs Issa thrown out
The Supreme Court has struck out a libel suit brought against Muna Issa, daughter of Superclubs' boss, John Issa, in 2007, by Sandals' principal, Gordon 'Butch' Stewart.

Justice Roy Anderson struck out the case earlier this week following an application from Issa's attorneys, Abe Dabdoub, instructed by Raymond Clough.

In the case, filed October 2007, Stewart sought damages for libel after he claimed Issa had forwarded an electronic mail, to journalist Owen James, containing a letter written by a Dr Paulette Robinson to Minister of Tourism Edmund Bartlett, making certain allegations and derogatory comments about Stewart.

In an application to the Supreme Court to have the matter struck out, however, Issa's attorneys argued, among other things, that the claim was frivolous and vexatious and an abuse of the processes of the court, as the extent of the publication was minimal.

Justice Anderson upheld the defendant's arguments on the basis that no substantive tort had been committed.

He stayed the order for 14 days and made its effect conditional upon the issuance of an apology by the defendant, Issa, to the claimant, Stewart, within the period.

The apology is to be prepared by counsel for both parties and is to be agreed by Justice Anderson.

Costs are also to be awarded against Stewart to Issa.

Justice Anderson, in handing down his decision, however, granted Stewart leave to appeal the ruling.

Efforts to reach his attorney, Diana Gentles, yesterday were unsuccessful.
